The current cutoff time is 2 am in Boston, but Encore Boston Harbor is trying to become an exception to the rule.

The popular saying "it's 5 o'clock somewhere" is often justification when consuming alcohol during non traditional hours. Many communities close their establishments at 1 am, and even in Boston, closing time rings in an hour later.

However, there's a catch. You must be gambling.

According to Boston.com, Wynn Resorts officials are asking the state for permission to serve alcohol until 4 a.m. at the Encore Boston Harbor. Earlier this week, they filed documents with the Massachusetts Gaming Commission. According to the documents, anyone receiving drinks between 2 a.m. and 4 a.m would have to be “actively engaged in gambling” on the casino floor. It is common for casinos to comp alcoholic beverages for those gambling.

This move would not be unprecedented in the Commonwealth. According to Boston.com, last year the commission also voted to allow the MGM Springfield casino to serve alcohol until 4 a.m. on the casino floor.

The commission is accepting feedback from the public before making their decision.
